9/11 Silicosis: Interstitial Lung Disease Claims & VCF Compensation

Who qualifies for 9/11 silicosis compensation?

Anyone diagnosed with silicosis following presence in the covered 9/11 areas, at the Pentagon, or in Shanksville, Pennsylvania during the covered periods may qualify for VCF compensation. This includes area workers, residents, students, teachers, first responders, cleanup and recovery workers, volunteers, and surviving family members of those who died from 9/11-related silicosis.

Free medical care runs through the WTC Health Program, which covers Manhattan south of Houston Street and any block in Brooklyn within 1.5 miles of the former World Trade Center site. Compensation runs through the VCF, which covers Manhattan south of Canal Street plus routes of debris removal.

If you were between Canal and Houston Street, you may still qualify for both. Daily life in Lower Manhattan rarely stopped at Canal Street, and presence can be established with records or sworn affidavits.

How is silicosis certified under the WTC Health Program?

Silicosis is a pneumoconiosis, a lung disease caused by inhaling mineral dust, and it is certified within the interstitial lung disease (ILD) category, the WTC Health Program's category for restrictive and scarring lung conditions. Like pulmonary fibrosis, silicosis is not named as its own separate condition on the WTC Health Program's list; it is certified as one of the recognized types of interstitial lung disease, which the Program treats as a single category rather than a fixed list of named diseases.

Silicosis is caused by inhaling crystalline silica dust, which embeds in lung tissue and triggers scarring and the formation of small nodules. Crystalline silica was a major component of the pulverized concrete and glass released by the collapse of the World Trade Center towers, alongside asbestos, cement dust, and other hazardous substances documented in toxicology studies of WTC dust.

Among NYC WTC responders and survivors, silicosis and other pneumoconioses are among the interstitial lung diseases documented in the exposed population. Silicosis can develop as a chronic disease over years of lower-level exposure or, less commonly, as an accelerated or acute disease following intense, short-term exposure to very high concentrations of silica dust, of the kind present at Ground Zero. Because interstitial lung disease can progress with a silent period before symptoms appear, published research on the WTC-exposed population has recognized that its true incidence may still be underestimated.

Certification does not require proof that 9/11 exposure was the only cause of the condition. The legal standard is whether the exposure was substantially likely to be a significant factor in aggravating, contributing to, or causing it.

Silicosis symptoms depend on how quickly the disease develops. Chronic silicosis, which develops over years, typically causes shortness of breath, a persistent cough, and fatigue that worsen gradually. Accelerated and acute silicosis, which follow shorter and more intense exposures, can progress faster and cause more severe shortness of breath, cough, weakness, and weight loss over months rather than years.

Because these symptoms overlap with other lung conditions, silicosis is typically confirmed through a documented history of silica dust exposure, imaging such as a chest X-ray or high-resolution CT scan showing characteristic nodules, and pulmonary function testing showing a restrictive pattern.

Anyone with 9/11 exposure history who develops these symptoms should be evaluated by a WTC Health Program participating provider. The diagnosis can be made by any qualified physician, but certification of the condition as 9/11-related is made by the WTC Health Program.

Silicosis falls within interstitial lung disease, the one WTC Health Program aerodigestive category with no maximum time interval. The Administrator reviewed the published science on interstitial disease and determined that it can have an insidious, silent onset, and that no reliable evidence supported selecting a cutoff. The same policy also does not require a minimum time interval for any aerodigestive category.

This means a silicosis diagnosis can be certified as 9/11-related regardless of how long ago the qualifying exposure occurred, and regardless of how soon after exposure symptoms first appeared. This latency framework was set by the WTC Health Program Administrator in the Time Intervals for New-Onset Aerodigestive Disorders policy, most recently revised August 30, 2017, and has no exceptions.

The two-year VCF registration deadline runs from the date the WTC Health Program certifies the silicosis as 9/11-related, not from the date of diagnosis. A silicosis diagnosis from years ago remains eligible for certification and compensation review if registration is completed within the applicable window.

How much does the VCF pay for 9/11 silicosis?

Certified 9/11 silicosis qualifies claimants for free medical treatment through the WTC Health Program and allows the claimant to submit a claim for financial compensation through the September 11th Victim Compensation Fund. The VCF's non-economic loss award for silicosis is published in its Non-Economic Loss Awards and Certified Conditions Fact Sheet.

Presumptively severe award

• Silicosis baseline: $90,000. The VCF has determined that interstitial lung disease, the category silicosis falls under, is presumptively severe and debilitating, warranting the statutory ceiling for a single non-cancer condition.
• No additional documentation required. Unlike most non-cancer conditions, which start lower in the $10,000 to $90,000 range and rise with medical evidence of severity, a certified silicosis diagnosis is awarded the $90,000 ceiling without submitting further records beyond the certification itself.

Economic loss and wrongful death

In addition to non-economic loss, the VCF may award economic loss for medical expenses and lost earnings. Wrongful death compensation is available to the personal representatives of individuals who died from 9/11-related silicosis. Attorney fees for VCF claims are capped at 10% by federal statute.

Additional certified conditions do not automatically raise a VCF award. Non-economic loss for non-cancer conditions is capped at $90,000 for a single condition, and the VCF's aggregate maximum of $340,000 is reserved for claims involving two or more certified cancers or a certified cancer alongside another certified condition of extraordinary severity. A certified cancer is required to reach that higher figure.
